2. Scope of these terms
These Terms govern:
- purchases made through the Stormlabs store
- access to plugin downloads
- automatic updates and support services
They apply to both:
- Consumers (private individuals)
- Professional customers (business users)
By placing an order, the customer accepts these Terms.
3. Definitions
- Software: WordPress plugins developed by Stormlabs
- Services: download access, update delivery, license validation, support
- License key: technical key enabling access to certain Services
- Customer: person or entity purchasing from Stormlabs
4. Nature of the software license (GPL)
Stormlabs plugins are distributed under the GNU General Public License v2 or later (GPL).
This means:
- the Software may be used, modified and redistributed under GPL terms
- no ownership of intellectual property is transferred
- only a usage license under GPL is granted
A purchase does not restrict GPL rights.
Payment grants access to Stormlabs commercial Services, not ownership of the Software.
5. Commercial services and license period
A purchase grants the customer access to Stormlabs commercial Services, which may include:
- access to plugin download files
- automatic updates via Stormlabs servers
- license activation infrastructure
- technical support
These Services may be provided:
- for a fixed period (for example: 1 year), or
- as an automatically renewing subscription, or
- as another entitlement duration indicated on the product page
The applicable duration and conditions are clearly shown before purchase.
When the Service period expires:
automatic updates, support, and download access may be suspended until renewed
the customer may continue using the Software under GPL terms
6. Subscriptions and automatic renewals
(Some products may be sold as subscriptions.)
If a product is offered as a subscription:
- the subscription renews automatically at the end of each billing period
- renewal occurs using the payment method provided at purchase
The renewal price:
- will be communicated before the initial purchase
- may change for future billing periods, with prior notice where required by law
Customers may cancel their subscription at any time through their account or by contacting Stormlabs.
Cancellation:
- stops future renewals
- does not retroactively refund the current billing period unless required by law
Stormlabs may suspend or terminate subscriptions in case of:
- payment failure
- fraud or abuse
- violation of these Terms
7. Renewal notifications
For consumer customers, Stormlabs will make reasonable efforts to provide advance notice before automatic renewal where legally required.
Failure to receive such notification due to spam filtering, incorrect email address, or technical issues beyond Stormlabs’ control does not invalidate a renewal that was clearly disclosed at purchase.
8. Ordering process
The contract is formed when:
- the customer places an order
- payment is successfully processed via Mollie
- confirmation is issued
Stormlabs reserves the right to refuse orders in case of:
- fraud suspicion
- incorrect pricing errors
- misuse of Services
9. Prices and VAT
Prices are shown:
- including VAT where legally required
- excluding VAT for eligible business customers
VAT is calculated according to EU tax regulations.
Invoices are issued electronically.
For EU business customers with valid VAT numbers, reverse charge VAT may apply.
10. Payment
Payment
Payments are processed securely via Mollie. Available methods are shown at checkout
For subscription products:
- the customer authorizes recurring charges for each billing period
- charges occur automatically unless the subscription is cancelled before renewal
Access to Software or Services may be suspended if payment fails.
11. Delivery of digital content
Delivery is electronic only.
After payment:
- download access is made available immediately
- account access and/or license key is provided
Delivery is considered complete once access is granted.
Stormlabs is not responsible for:
- incorrect email address provided by the customer
- spam filtering or delivery delays outside its control
12. Right of withdrawal (consumers)
Consumers normally have a 14-day withdrawal right for online purchases.
However, for digital content:
By completing the purchase, the consumer:
- explicitly requests immediate delivery of digital content
- acknowledges that the right of withdrawal is lost once download or access begins
This consent is collected during checkout.
Professional customers do not benefit from withdrawal rights.
13. Refund policy
Because the Software is delivered digitally:
Refunds are only granted when:
- required by law, or
- the Software is demonstrably defective and cannot be fixed within a reasonable time
Refunds are not guaranteed for:
- incompatibility with third-party plugins/themes/hosting
- change of mind after download
- lack of technical knowledge
Stormlabs may request troubleshooting information before granting refunds.
For subscription renewals:
- renewal payments are generally non-refundable once the new billing period has started
- exceptions apply only where required by applicable consumer law
14. License key usage
License keys:
- enable access to automatic updates and/or Services
- may be limited to a number of domains or installations
- must not be shared publicly or abused
Stormlabs may deactivate keys in case of:
- fraud
- resale in violation of fair use
- automated abuse of update servers
Deactivation does not affect GPL rights to use the Software already obtained.
15. Support and updates
Support is provided:
- via the contact channels listed on the website
- within reasonable effort
Stormlabs does not guarantee:
- response within fixed time
- compatibility with all WordPress environments
- continuous availability of update servers
Updates may:
- add features
- fix bugs
- change compatibility requirements
16. Compatibility and technical requirements
The customer is responsible for ensuring:
- WordPress version compatibility
- PHP version compatibility
- hosting environment suitability
Stormlabs is not liable for conflicts with:
- third-party plugins
- themes
- custom code
17. Intellectual property
All intellectual property rights in the Software remain with Stormlabs or its licensors.
Except for GPL rights, nothing in these Terms transfers ownership.
Brand names, logos and website content remain proprietary.
18. Limitation of liability
To the maximum extent permitted by law:
- Software and Services are provided “as is”
- Stormlabs is not liable for:
- indirect damages
- data loss
- lost profits
- business interruption
Total liability is limited to the amount paid for the purchase concerned.
Nothing in these Terms excludes liability where exclusion is prohibited by law.
19. Accounts
Customers are responsible for:
- maintaining login confidentiality
- activity under their account
Stormlabs may suspend accounts involved in abuse or fraud.
20. Privacy and data processing
Stormlabs processes personal data in accordance with its Privacy Policy.
The Software may contact Stormlabs servers to:
- validate license status
- check for updates
- retrieve downloads
This processing is necessary to provide the Services.
21. Force majeure
Stormlabs is not liable for failure to perform obligations due to events beyond reasonable control, including:
- hosting failures
- network outages
- cyber incidents
- government restrictions
22. Governing law and jurisdiction
These Terms are governed by Belgian law.
For professional customers:
- disputes fall under the courts of Stormlabs’ registered seat
Consumers retain mandatory rights under their local EU consumer law.
23. Changes to these Terms
Stormlabs may update these Terms.
The version in force at the time of purchase applies to that purchase.
